COLORADO SPRINGS - The grandmother of three of the kids burned in Tuesday's fire tells NEWSCHANNEL 13 that Maria Joseph isn't the monster many think she is.

"She's been under a lot of stress," says Linda Joseph from her Killeen, Texas home. "She just snapped!"

According to a source close to the investigation, Maria Joseph doused her five kids with some kind of accelerant. The police source adds that her intent was to kill all five, but only 16-month old Ashya died of her injuries. The rest are at Denver Children's Hospital, where they are in critical condition. According to the grandmother, two of the kids will be flown back to Shriners Hospital for Children in Galveston, Texas where they will get better care.

"It's not close to us, it's about 6 hours away," Linda Joseph says.

According to Colorado Springs Police, Simeon Joseph committed suicide in the same home off Galena court back in October. The grandmother says Maria has been trying to take care of all five children, three of whom were Simeon's.

"She has no family support there," says Linda Joseph.

Simeon Joseph's family invited Maria to come and live with them in Texas, but she refused.

"We can't believe she did this," says Linda Joseph. "She was a stay at home mom and she was a great mom cooking meals every night."

UPDATE: DEADLY HOUSE FIRE

THE CASE: Five children were severely burned in a suspected arson at their home, 3225 Galena Court, late Jan. 28. One of the children died and their mother is suspected of starting the fire.

THE VICTIMS: Ashya Joseph, 1, died Jan. 28 in the fire. Supreme Joseph, 5, was upgraded to fair condition at Children’s Hospital in Denver. Domenic, 8, Dontrell, 9, and Amarjahan, 3, remained in critical condition as of last week. Two are being treated at the Shriners Hospital in Galveston, Texas. The children are “silent patients” because they are in the custody of the El Paso County Department of Human Services, so hospital officials could not provide updated patient-condition information today.

THE SUSPECT: Maria Darlene Joseph, 25, who also uses the last name Gardner, was arrested on suspicion of first-degree murder. She was found a block from the fire with superficial wounds to both wrists, both arms, neck and ankle, according to an arrest affidavit.

WHAT’S NEW: Prosecutors filed 19 charges against Joseph today. Those charges include: first-degree murder; five counts of child abuse, knowingly or recklessly causing death; four counts of attempted murder; and arson. Joseph could face life in prison without parole if convicted of first-degree murder.

WHAT’S NEXT: Joseph, who is being held without bond at the El Paso County Criminal Justice Center, is due back in court April 21 for a preliminary hearing, at which time prosecutors must prove to 4th Judicial District Judge Timothy Simmons that it’s likely Joseph committed the crimes she is charged with.

UPDATE: MOTHER ACCUSED OF SETTING CHILDREN ON FIRE

The case: An 8-year-old boy called Colorado Springs police to 3225 Galena Court Jan. 28 to report he and his siblings had been set on fire. The fire killed a 16-month old girl and severely burned the four other children in the house. Investigators believe the children were all in the master bedroom sleeping when they were doused with gasoline, then lit on fire.

The victims: Ashia Joseph, 1, died in her crib. Severely burned were: Amarjahan Joseph, 4; Supreme Joseph, 5; Domenic Gardner, 9, and Dontrell Gardner, 10.

The suspect: Maria Darlene Gardner, who also uses the last name Joseph, is the children's mother. Gardner, 25, has pleaded not guilty by reason of insanity to 17 felony charges in connection with the fire, including first-degree murder. Her public defenders have asserted her husband's suicide in October sent her over the edge mentally.

What's new: On Thursday, 4th Judicial District Judge Timothy Simmons set Gardner's trial for Jan. 20.

What's next: With Gardner's insanity plea, prosecutors will have to prove beyond a reasonable doubt not only that Garner committed the alleged crimes, but also disprove to jurors that she was insane at the time. Gardner is being held without bond at the El Paso County Criminal Justice Center.
