Rights activists predicted more cases being brought against Bulgaria at the European Court of Human Rights after the Supreme Court of Cassation in Sofia ruled on Monday that transgender people will no longer be eligible to change documents in accordance with their identity.

“The constitution and Bulgarian legislation are built on the understanding of the binary existence of the human species,” the ruling said.

Twenty-eight judges voted in favour, but 21 expressed dissenting opinions. According to legal news website lex.bg, it was a rare case of an issue dividing the court so starkly.

The dissenting judges’ opinion said that the court’s decision imposed “a general, automatic and unified ban on legal gender change”.

They argued that “a legal change of gender is not in contradiction with the ‘binary existence of the human species’, because it does not refer to a ‘third gender’”.

Adela Katchaounova, legal defense programme director at the Bulgarian Helsinki Committee, criticised the court’s decision as a populist ruling “in favour of an imaginary public interest”.

“It shows a clear line of regression in judicial thinking in Bulgaria. The European Court of Human Rights has spoken before against such a hard line from the Bulgarian courts, which often ignore personal feelings of humiliation and defencelessness,” Katchaounova told BIRN.

In the end, in the 6th district of "Lyulin" the vehicle was stopped by the law enforcement authorities. However, its driver managed to get out of the car and escape.

Bulgaria will ask for an exception to the sanctions for the import of parts for nuclear power plants that cannot be produced outside of Russia - it is about 41 items, including software and hardware, which are used in the headquarters in Kozloduy NPP, explained the deputy minister.

"The countries that have such equipment believe that these supplies should continue. Otherwise, the affected countries are within their right to take countermeasures," Bozhkov said without elaborating and without being asked what those measures could be.

Bulgaria’s Constitutional Court has rejected an appeal from 50 MPs to rule on the National Assembly’s decision to supply military materiel to Ukraine as inadmissible and closed the case.

In its ruling, the high court said that it was asked to assess “the ethical side of foreign policy in a specific political context” that presented the court with a choice “that can be subject solely to political discretion.”

The court said that while it can rule on political matters, including those relating to foreign policy, in cases when there was a “conflict of competence” between state institutions, ruling on the substance of this complaint would represent “entering the field of discretion of political institutions and re-ordering their priority values and political goals.”

According to the report, last year Bulgaria provided defense funds equal to 1.54% of GDP. The report states that so far only seven countries of the Alliance meet the goal of spending reaching two percent of GDP. Bulgaria fulfills the goal set by NATO for at least a 20% share of equipment costs from the total national defense budget.

The outcome points to further lengthy coalition talks that are unlikely to produce a stable government due to personal antipathy among the leaders of the two main blocs, analysts say, possibly leading to a sixth election later this year.

Failure yet again to produce a functioning government could undermine Bulgaria's hopes of joining the euro currency zone in the near term and of being able to effectively use European Union COVID-19 recovery aid.

US Secretary of State Antony Blinken has pledged to help Bulgaria, via the Pentagon, with the supply of replacement resources of many weapons.

This was stated by the acting foreign minister and future ambassador to NATO Nikolay Milkov to Bulgarian journalists in Brussels. He participated in the meeting of the first diplomats of the member countries of the pact.

Blinken inquired whether the US military department had been informed and promised to follow up on the matter.

Did Bulgaria give Ukraine old weapons, and in return receive new ones from the allies, asked Bulgarian media "Club Z".

"This issue in this context was not exactly discussed. It was discussed that we have a draining resource and a capability gap. When, for example, their jets expire, which will happen soon, we will have 2 or 3 years ahead of us, during which we will have no other options at all to protect our airspace. We will have to rely on the allies," replied Milkov.

And he added that what would happen to our armaments is a matter that should be decided at other levels by parliament, most likely by the future government.

It is questionable whether this referendum is even admissible, since the topic is part of an international treaty that Bulgaria has signed.

According to the legal text, a referendum on issues regulated in international treaties concluded by the Republic of Bulgaria can be held before their ratification

"What we will achieve is that there will be a referendum in the fall together with the local elections, in which the Bulgarian citizens will say, for the first time, they will be asked whether they want the Bulgarian lev to be preserved or destroyed," commented the leader of "Vazrazhdane" (Revival) Kostadin Kostadinov.

He added that these 590 thousand signatures are on a total of 37 thousand pages. The poll question is "Do you agree that the Bulgarian lev should be the only official currency in Bulgaria until 2043?".

The initiative committee submitted the signature before the deadline, which is Monday, April 10.

He also pointed out that our country intends to work directly with Bulgarian companies when Kyiv wants to buy ammunition. Antisemitism in Bulgaria is becoming a growing concern in the wake of two acts of vandalism in the capital, Sofia, with the head of the country’s Jewish community describing the episodes as “highly disturbing,” in an interview with a German news outlet.

Earlier this month, a craft beer store was defaced with a six pointed star and the word “Jude” — the German word for “Jew” which the Nazis daubed at the entrances to Jewish-owned stores during the 1930s in a signal to consumers to boycott these outlets, according to the German broadcaster DW. A swastika was then sprayed on the front of nearby store a few days later.

Speaking to DW, Alexander Oscar — chairman of “Shalom,” which represents Bulgaria’s small Jewish community numbering between 2-6,000 people — said he had been disappointed by the lack of an official reaction to the “highly disturbing” incidents.

“Any other civilized European country, a country that is a member of the European Union, would have a reaction,” Oscar said.

“I do not agree to provide ammunition, especially from the Bulgarian army reserves,” Radev told Zelensky, according to one of the translations. “I continue to maintain that this conflict has no military solution and more and more weapons will not solve it.”

According to Politico’s description of the incident, Zelensky “savaged” Radev and “opened up with both barrels” to “maul” the Bulgarian president, delivering his words “with measured scorn” and “barbed irony” as Radev “took refuge” in the sheet of paper in his hands. The Bulgarian president eventually asked the cameras to leave the room.

NATO countries have sent billions of dollars worth of weapons, ammunition and equipment to Ukraine since February 2022, while insisting they were not directly involved in the conflict with Russia.

An investigation is underway against the pro-Russian party "Vazrazhdane" for a particularly vile Nazi collage published on the Telegram social network, which depicts former foreign minister of Bulgaria Solomon Passy.

The Sofia City Prosecutor's Office has assigned a joint investigation to the National Security Agency and the State Police for a crime under Art. 162 and Art. 164 of the Criminal Code.



In a statement from the prosecutor's office, it is said that the inspection was carried out at the request of the Association "Organization of Jews in Bulgaria Shalom". Solomon Passy is of Jewish descent.

In the course of the investigation, it must be established whether, through speech, print, or other means of mass information, through information systems or in any other way, citizens and/or people's representatives from the 49th National Assembly preach or incite discrimination, violence or hatred, based on race, nationality, ethnicity or religion.

The period for carrying out an inspection by law is up to three months, after which an assessment will be made as to whether there is sufficient data on a committed crime of a general nature to initiate pre-trial proceedings.

The public will be informed of the results.

Shortly before that, "Shalom" also announced that they had filed a report against "Vazrazhdane".

The collage on a social network, for which "Shalom" filed a report with the prosecutor's office against the "Vazrazhdane" party, is not on the official channel of the party. This was said by the leader of the political force Kostadin Kostadinov to journalists on the sidelines of the parliament.

According to him, the collage is a comment on a post in a group that, in his words, has nothing to do with "Vazrazhdane". "There were two lies: firstly - it is not the official channel of 'Vazrazhdane' and secondly - it is in a group, and the publication and the comment are on this person A.P."

The pro-Russian political party "Vazrazhdane" has received help from "There Is Such a People" and the independent MP Radostin Vassilev to appeal to the Constitutional Court about the decision of the National Assembly to reject the proposal to call a referendum against the euro. This was announced by party leader Kostadin Kostadinov at a briefing on the sidelines of the parliament.

He stated that the party has settled on this option after President Rumen Radev refused to call a referendum at the beginning of the week. As a result, the formation accused him of treason.

Referral to the Constitutional Court, however, requires the signatures of a fifth of the deputies (48 MPs), therefore "Vazrazhdane", which has only 37 deputies, has sought support from the parliamentary groups that supported the proposal to call a referendum.

However, according to documents from the army and US authorities, Bulgaria has supplied 155 mm shells to Ukraine with the mediation of the United States, with deliveries planned for next year as well.

The previously undisclosed deal sheds light on how the United States has procured coveted ammunition, how Bulgaria has delicately balanced its foreign policy and how some small companies have dethroned major arms giants amid tensions over the war in Ukraine.

Ukraine's hunger for shells has defined the war as artillery-oriented, and Ukrainian gunners fire up to 240,000 rounds a month, or 12 times the US's monthly output. The US effort to power Ukrainian guns has taken many forms, but one of the biggest is a $522 million US military contract awarded in January to defense giant Northrop Grumman and a smaller company, Global Military Products. Shipping should have started in March.

The collage depicts former foreign minister Solomon Passi, who is of Jewish descent, dressed in the type of clothing Jews were forced to wear during the Holocaust, and in the clutches of men in Nazi-type uniforms, with the caption: “If you don’t want Russian gas, come and have some of ours”.

The Shalom Organization of the Jews in Bulgaria has lodged a complaint against Vuzrazhdane at the Sofia Regional Prosecutor’s Office, while Vuzrazhdane has filed a counter-claim against Shalom, claiming that it is not responsible for the posting of the collage and alleging that the Jewish organisation has lodged a complaint based on “false” evidence.

Among the latest to express condemnation is the embassy of Israel in Sofia, which said that it strongly condemns antisemitic statements and in particular, the disturbing collage with the face of Passi, distributed on the internet “which takes us back to the darkest period in the history of mankind – the Holocaust”.

“Such displays of hate speech have no place and should not be tolerated in a democratic society,” the Israeli embassy said.
