Spanish Police Arrest Writer Wanted in Austria for Holocaust Denial

Spanish police on Thursday arrested a right-wing writer and publisher wanted in his home country of Austria for repeatedly denying the existence of the Jewish Holocaust and the use of gas chambers, officials said.

Gerd Honsik was arrested in the southern city of Malaga, a police spokeswoman said. No more details on his arrest were immediately available.

Honsik had fled to Spain after being convicted in 1992 in Austria of neo-Nazi activities and sentenced to one year in prison for writings that defended Adolf Hitler's Third Reich.....

Spain has 90 days from the point when the arrest warrant was issued to decide whether to extradite Honsik......

VIENNA, Austria - A right-wing Austrian writer who fled to Spain after being convicted of Holocaust denial charges 15 years ago must serve his 18-month sentence, Vienna's highest court said Monday.

Gerd Honsik, 67, must serve out the sentence handed down in 1992, the court said, rejecting his plea for leniency because of his age and an unspecified illness. However, the court also turned down a prosecution request to make the former fugitive serve even more time.

Honsik was captured in southern Spain in August and extradited in October. He fled after being convicted of denying the existence of the Holocaust and claiming the Nazis never used gas chambers — grounds for criminal prosecution in Austria.

.....Honsik published writings disputing that the Nazis killed 6 million Jews during World War II. Among his books is one titled "Acquittal for Hitler?"

Austria's law making it a crime to deny the Holocaust applies to "whoever denies, grossly plays down, approves or tries to excuse the National Socialist genocide or other National Socialist crimes against humanity in a print publication, in broadcast or other media."

The crime is punishable by up to 10 years in prison....

The Austrian poet, author and historian Gerd Honsik was arrested on 23rd August, 2007 in his house near Malaga (Spain) after fifteen years exile there and sent to Madrid. Since then he has remained in custody prior to extradition (see update below).

Gerd Honsik has been hounded for 20 years because of his book "Freispruch für Hitler?" (Acquittal for Hitler?). In Vienna he was sentenced to one and a half years in prison because of questions he raised regarding the gas chambers and for telling the truth about the Katyn massacre. The judgment was made possible because Professor Jagschitz had given false evidence as a court expert in favour of the Holocaust accusation.

The arrest was made on order of the Austrian Ministry of Justice with the help of the new European Arrest Warrant contrived and initiated by the Federal Republic of Germany. According to this it is not the offence that is given priority but only the request for extradition. This regulation assumes that EU member states act according to the rule of law and therefore a case check should not be necessary by the country making the extradition.

Regarding the extradition of Honsik the deciding issue was initially his conviction at the trial by jury in the Vienna in 1992. There the poet was accused on account of his book "Acquittal for Hitler?" and was sentenced to one and a half years in prison. However, the judgment is not legally binding because before exhausting all legal avenues Gerd Honsik took exile in Spain.

His request for asylum in Spain was rejected at the time, however, the Spanish High Court recognised in its final judgment that the contents of the book in question would not be illegal in Spain.

The Austrian media rejoiced when news of the poet's arrest was made known. On the 24th August, 2007 the online news at "oe24.at" boasted of the court judgment and rejoiced: "The jurors unanimously found Honsik guilty on all charges."

It's nauseating how these hacks can be proud of such a verdict. When one considers the verdict also includes a prison sentence "for his denial of the Katyn massacre". In public and in his writings Honsik had pointed out that the German Imperial Government was wrongly accused before the international military tribunal in Nuremberg of the Katyn massacre (1945/46) and that Stalin's murderers had carried out the killings.

This historically and forensically proven statement cost Honsik his freedom in addition to his questions regarding the gas chambers. Although in 1992 it was sufficiently well known that Beria was the executor of Stalin’s murder of roughly 30,000 Polish soldiers and officers shot in the back of the head in the Katyn forest Gerd Honsik was nevertheless sentenced to imprisonment for speaking the truth.

For the court, telling the truth about Katyn satisfied the so-called criminal offence in Austria of “Wiederbetätigung“ [activity promoting NS ideology] which is punishable by up to 20 years imprisonment.

The incriminating questions in Gerd Honsik’s book "Acquittal for Hitler?" are commented on in the work by prominent witnesses. These polite questions and the scientific answers were overstated by the evident perjury of Professor Jagschitzat at the time to constitute the criminal offence of so-called “Wiederbetätigung“ [promoting the NS].

The author endured a total 20 years of persecution as a consequence of this pioneering book because he repeatedly posed questions relating to the gas chambers. The main issues in the book were covered by the expert, whose presence was requested by the court, by giving false evidence (under oath) in favour of the Holocaust indictment...and now Honsik should suffer for this.

With the publication of the book Honsik also fulfilled his promise to his friend and confessor, Father Viktor Knirsch. Father Knirsch knew of the reports of the Catholic priests who provided spiritual care in Auschwitz. The reports of the priests active in Auschwitz and the political Holocaust historiography were poles apart.

Because of this the priest wanted to have understandable, logical answers to questions relating to the gas chambers. This is clear in the preface to the book where the priest warns: "The truth is always composed, while lies cry out for earthly judges." Later, when the book was banned, Father Knirsch died under tragic circumstances which were never explained - in a closed institution.



Five years of preliminary investigations, seizure of his account with 50,000 DM, three years in prison in Austria and Germany. This was the political establishment’s answer to Honsik's politely put questions in "Acquittal for Hitler?".

Honsik's book not only went down in the annals of revisionism but also of justice. For the first time in decades in their pursuit of Holocaust non-believers the justice system called in two experts to examine the correctness of the contents of "Acquittal for Hitler?" This was the prelude of investigative proceedings of a law-abiding State which have never been applied before or since the Honsik process.

Did Prof. Dr. Gerhard Jagschitz commit perjury for the Holocaust? A natural history scientist and a professor of history were commissioned with the investigation. The scientist discontinued his work rather hastily without presenting a scientifically based proof that there were gas chambers. The historian, Prof. Dr. Gerhard Jagschitz, researched for five years throughout the archives of the world searching for proof of gas chambers.

In the Jad Waschem Museum, the Holocaust museum of Israel, he was refused permission to access records. In the end, after five years of research, Prof. Jagschitz had to inform the court in an interim opinion that he as expert had found no documentary evidence for the existence of gas chambers.

However, during the process as the expert he was questioned by the judge and under oath Jagschitz explained that probably no documentary proofs of the gas chambers are to be found. However, the name ‘Sonderbehandlung’ (special treatment) in the NS State had indeed been used as a code word for "gassings".

With this statement made under oath the Holocaust expert Jagschitz raised suspicion that he had committed the crime of perjury. Unfortunately, at that time this fact was unknown to the defendant. That is, that Professor Jagschitz had already explicitly explained in 1977 during a newspaper interview, "‘Sonderbehandlung’ (special treatment) signified a better treatment and not homicide". During his interview in 1977 Jagschitz defined ‘Sonderbehandlung’ as follows: "... every prisoner had at least his own flat. If requested they were allowed to have family members with them". In addition, this was printed in the Austrian weekly journal "Format" No. 21 in 2001.

However, in the gas chamber process against Gerd Honsik in Vienna in 1992 the sworn in expert Jagschitz made the following statement: "Whenever the word ‘Sonderbehandlung’ is used it is always without exception a paraphrase for the word ‘killing’!"

Perjury for the Holocaust? It will be interesting to watch the course the Honsik case takes. If he is extradited to Austria the previous court case must be continued. This would be extremely embarrassing for the regime. In the appeals procedure the suspicion that Jagschitz committed perjury as a court expert must be examined and dealt with. In this case Professor Jagschitz would have to reckon with a conviction for perjury -- provided that the State follows the rule of law.

Nor will it be possible to hide the fact that Honsik was condemned wrongfully on charges relating to Katyn. If he is going to be judged according to principles of the rule of law he can expect satisfaction by way of a high damages for pain and suffering.

The question which the interested citizen will be asking himself is: Is the Holocaust perjury of Professor Jagschitz and the wrong court decision regarding Katyn really conclusive proof of the Holocaust?

Gerd Honsik (born 10 October 1941 in Vienna) is an Austrian writer and lyric poet, and a prominent Holocaust denier.

Life
Honsik's activities have included, among others, being a functionary in the Austrian "Volksbewegung" ("People's Movement"), also known as "Volksbewegung gegen Überfremdung" ("People's Movement against Foreign Infiltration") and "Ausländer-Halt-Bewegung" ("No More Foreigners Movement"), as well as in Germany's far-right NPD party. He was the founder of a militia group, the Nationale Front, which according to its manifesto carried out activities to effect "the abolition of the system".

He has also appeared under the pseudonym "Gerhon Endsik", an anagram of the syllables of his name extended by two letters, intended to allude to the (politically charged) German term Endsieg ("final victory").

Honsik has been fined and sentenced to jail in several Austrian court cases due to his activities as a Holocaust denier. He evaded his most recent sentence by fleeing the country, and currently resides in Spain.

Honsik now distributes the magazine Halt ("Stop") at irregular intervals from Spain. The magazine publishes Holocaust-denying and anti-Semitic articles.

Honsik was arrested in Málaga Spain on the 24th of August 2007 after a recent change in Spanish legislation. On the 4th of October 2007 Honsik was extradited to Austria to serve out an 18-month prison sentence stemming from a 1992 conviction for Holocaust denial.

It's a weird feeling to see someone in shackles who didn't physically harm anyone or directly threaten anyone, or steal or damage property.

The range of possible criminal actions is pretty limited, and the expression of an idea short of yelling fire in a theater should NEVER be a crime. But there he is -- idea criminal, his hands cuffed, in a "Western" country no less.

Well, on second thought, if "Holocaust denial" can be a crime, maybe judaism can be a crime too. Certainly the material justification is there.

A right-wing Austrian author was found guilty Monday of glorifying the Nazi era and sentenced to five years in prison.

Appeals were lodged both by the defense lawyer of Gerd Honsik and by the public prosecutor, who found the sentence too mild.

Honsik, 67, was found guilty of "Wiederbetaetigung" - which means "re-engaging" in Nazi era beliefs. The crime is punishable by up to 20 years in prison.

Honsik wrote a book, "Hitler Innocent?," in which he attempted to justify some Nazi-era crimes.

He was originally convicted of neo-Nazi activities in 1992 for writings that defended Adolf Hitler's Third Reich, but he fled to Spain, where authorities arrested him in October 2007 and subsequently extradited him.

Between 1986 and 1989, Honsik published writings disputing that the Nazis killed millions of Jews at Auschwitz and other concentration camps during World War II.

Austrian authorities have said they suspect him of committing similar offenses since Austria enacted a landmark 1992 law making it a crime to deny the Holocaust or promote Nazi propaganda.
