(JTA) — The parents of Jewish American college student Otto Warmbier filed a claim for a North Korean cargo ship seized by the U.S.

The claim filed in federal court in New York on Wednesday in New York said the asset could be used to pay off part of a $501 million wrongful death judgement against the North Korean government for the death of their son, who was detained on trumped up charges in the country for over a year and died shortly after he was returned home in June 2017 in a coma.

The University of Virginia student had been sentenced to 15 years of hard labor for allegedly stealing a propaganda poster. His doctors in the U.S. said he suffered extensive brain damage. Warmbier was traveling to Hong Kong for a study abroad program when he decided to visit North Korea on a guided tour.

“The Warmbiers are committed to holding North Korea accountable for the death of their son Otto, and will work tirelessly to seize North Korean assets wherever they may be found,” Ben Hatch, an attorney for the family, told The Associated Press in a statement.

A federal judge has given the green light for the sale of a seized North Korea vessel to pay down the judgement awarded to the parents of Otto Warmbier, who died after being detained in the hermit kingdom.

Parents Frederick and Cynthia Warmbier won a $500 million judgment against North Korea for the death of their son, who was arrested at the Pyongyang airport in 2016 — during a guided tour of the rogue state ahead of a study abroad program in Hong Kong — for stealing a propaganda poster.

Warmbier was sentenced to 15 years of hard labor for the alleged theft and served 18 months before the Trump administration negotiated his release. But he was sent home in a vegetative state and died a week later.

Proceeds from the sale of the ship, the Wise Honest, which reportedly could go for up to $3 million, will go to the Warmbiers to pay down the judgment. Manhattan federal court Judge Kevin Castel ruled in a filing signing off on the sale of the ship.

To date, the North Korean regime has not responded to the Warmbiers’ wrongful death claims, but has denied accusations that Warmbier was tortured during his detention, saying that the American was given “medical treatments and care with all sincerity” while he was a prisoner.

Fred had described Otto's teeth as having been “re-arranged” with pliers, but Sammarco reiterated that the postmortem exam found that “the teeth [were] natural and in good repair.” She discovered no significant scars, dismissing the one on his foot as not definitively indicative of anything. Other signs of physical trauma were also lacking. Both sides of Otto's brain had suffered simultaneously, meaning it had been starved of oxygen. (Blows to the head would have likely resulted in asymmetrical, rather than universal, damage.) Though the Warmbiers declined a surgical autopsy, non-invasive scans found no hairline bone fractures or other evidence of prior trauma. “His body was in excellent condition,” Sammarco said. “I'm sure he had to have round-the-clock care to be able to maintain the skin in the condition it was in.” When asked about the Warmbiers' claims, Sammarco answered, “They're grieving parents. I can't really make comments on what they said or their perceptions. But here in this office, we depend on science for our conclusions.” Three other individuals who had close contact with Otto on his return also did not notice any physical signs consistent with torture.

“The United States and its followers should bear in mind that if they raise the issue of our self-defensive measures at the U.N. Security Council meeting in this moment, it will further urge our desire to defend our sovereignty,” Kim said.

Facing possible legal action, the director of George Washington University's Hillel this week distanced himself from an e-mail accusing a third-year law student at the District school of being a terrorist.

Robert Fishman's letter in Monday's GW Hatchet, the school paper, comes after a March 29 e-mail to GWU Hillel's listserv urging Jewish students to attend a rally that was to take place on campus the following day and focus on divestment from Israel. Law student Fadi Kiblawi was the rally's leader.

The e-mail stated that Kiblawi is "considered a terrorist by the state of Israel, and has been convicted of crimes in both Israel and the United States. He advocates for the destruction of Israel, and in its place, the creation of a Palestinian state. He has also openly admitted to associating with suicide bombers and has made comments in the past about his desire to become a suicide bomber."

According to news reports, Kiblawi was detained in Israel in July 2004 for entering a closed military zone, but was not convicted of a crime. WJW could find no independent reports that he has called for the destruction of Israel or expressed a desire to become a suicide bomber.

In his letter on Monday, Fishman stated, "Regrettably, that correspondence included an unfortunate characterization of one of the lead activists [in the G.W. divestment campaign], Fadi Kiblawi, and has overshadowed the issue. As Kiblawi pointed out, the issue at hand should not be one of personality, but one of substance."

Fishman's letter came after Kiblawi had said he was considering legal action against both Hillel and the Jewish Defense League if allegations against him were not dropped.

Two “short-range projectiles” were launched from the coastal Wonsan area, and flew 230 kilometers (143 miles) at a maximum altitude of 30 kilometers (19 miles), South Korea’s Joint Chiefs of Staff reported.

“In a situation where the entire world is experiencing difficulties due to COVID-19, this kind of military act by North Korea is very inappropriate and we call for an immediate halt,” South Korea’s JCS said in a statement, according to Yonhap news agency.

North Korea on Wednesday marked the anniversary of the birthday of its national founder and Kim’s grandfather, Kim Il Sung, as a national holiday known as the Day of the Sun.

Senior officials paid tribute to the embalmed body of Kim Il Sung enshrined in the Kumsusan Palace of Sun, state media KCNA said on Thursday. But did not mention Kim as part of the delegation, unlike the past. He was also absent from photos released by party mouthpiece Rodong Sinmun.

His purported absence triggered speculation among experts that Kim, who is aged 36 and overweight, might be having health problems.

Kim recently missed the celebration of his grandfather's birthday on April 15, which raised speculation about his well-being. He had been seen four days before that at a government meeting.

Another US official told CNN Monday that the concerns about Kim's health are credible but the severity is hard to assess.
